Are There Employer Tax Credits for Hiring Felons?

In this distressed economy, more and more convicted felons are finding it harder to secure work.  We are often asked about the opportunities for employers to receive a tax credit should they hire someone with a felony.   The answer to this is ‘yes, but in an indirect way’.    While there are no federal tax credits for the hiring of people with felonies, there are tax credits given to employers who hire individuals on various welfare programs.   Because many convicted felons are unemployed, and unable to provide support to their spouse and children, it is not uncommon for the family to be on much-needed government assistance programs.   If an employer hires an individual who is on a program, there is a tax credit given to the employer.  This, indirectly, gives them a credit for hiring someone with a felony.

There are many convicted felons who are not interested in getting on the government welfare or government Medicaid program – and, this is understandable.   However, it is important to keep in mind that if this added benefit gives you one more opportunity to possibly find work, then it may be prudent to obtain government benefits for this reason.  Under the Obama’s jobs program, there has been discussion about giving credits to employers who hire someone who has been unemployed for a specific length of time but typically this is associated with those who are military veterans.  If you are not a military veteran then these provisions, if passed into law, would not apply.

Jobs for felons are challenging to find but with some tweaking of your financial status, you may be able to encourage an employer to hire you based on your government assistance programs.  Even for seasonal jobs part time, it is never too much to consider so make this an option when you are venturing out into your  job hunting this coming year.
